Terms of Service

1. Agreement

By creating an account, subscribing, or using Omnidam in any way — including guest chat where available — you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

Clicking "Sign up," "Create account," "Subscribe," or a similar button; completing registration; or continuing to use Omnidam after we post updated Terms constitutes acceptance.

2. Eligibility

Omnidam is for individuals who are at least 18 years old (or the age of legal majority where you live, whichever is higher). The service is not directed at children. You must have legal capacity to enter a binding contract.

Omnidam is a personal product for individual use. We do not offer team plans, enterprise contracts, or custom Data Processing Agreements. If your employer or client requires vendor onboarding or a DPA, Omnidam is not the right fit.

You may not use Omnidam if we have previously terminated your account for violating these Terms, or if doing so would violate applicable export-control or sanctions law.

3. The service

Omnidam is a multi-model AI workspace. It lets you chat with and compare outputs from third-party AI systems (currently ChatGPT and Gemini) through a single interface. Omnidam provides the workspace, routing, and user experience — not the underlying models themselves.

Omnidam is not professional legal, medical, financial, engineering, or other regulated advice. Features, models, and limits may change as we improve the product or as providers change their APIs.

• Guest use: limited chat without an account; conversations are not saved in your Omnidam workspace.
• Free plan: saved chats and workspace features with usage limits.
• Plus / Pro: expanded models, attachments, and higher limits via paid subscription.

4. Your account

You are responsible for accurate registration information and for keeping your email and credentials secure. You are responsible for activity under your account.

• Maintain one personal account unless we approve otherwise in writing.
• Do not share credentials or allow others to use your workspace.
• Notify us promptly if you suspect unauthorized access.
• You may delete your account and workspace data from Settings.

5. Acceptable use

Use Omnidam only for lawful purposes and in line with these Terms and each AI provider's acceptable-use policies. You agree not to:

• Generate or distribute illegal, harmful, deceptive, or abusive content.
• Harass, threaten, impersonate, or dox others.
• Upload malware or attempt to disrupt, probe, or reverse-engineer the service.
• Scrape, resell, or systematically automate access beyond normal personal use.
• Circumvent safety filters, usage limits, or account restrictions (including jailbreaking or prompt injection aimed at bypassing safeguards).
• Infringe intellectual property or privacy rights of others.
• Use Omnidam to develop or train competing AI systems without our permission.

We may suspend or terminate accounts that violate this section, with or without notice, and without refund where permitted by law.

6. Your content

You retain ownership of prompts, files, and other material you submit ("Your Inputs"). To operate the service, you grant Omnidam a limited license to store, process, and transmit Your Inputs — including to third-party AI providers — solely to provide Omnidam to you and to enforce these Terms.

You represent that you have the rights needed to submit Your Inputs and that they do not violate law or third-party rights. Do not submit highly sensitive personal data unless you accept how providers may process it.

Subject to these Terms and applicable law, you own AI responses and other outputs generated for you in your workspace ("Your Outputs"). You are responsible for reviewing Your Outputs before relying on or publishing them.

7. AI outputs & limitations

AI systems make mistakes. Models are probabilistic. They can hallucinate facts, cite non-existent sources, produce biased or outdated information, and generate insecure code. The same prompt may yield different answers at different times.

You must independently verify any factual, legal, medical, financial, or safety-critical information before acting on it. Do not use AI outputs for professional submissions, clinical decisions, or safety-critical systems without qualified human review.

Omnidam does not guarantee accuracy, originality, non-infringement, or fitness for a particular purpose of any AI output.

8. Third-party AI providers

Omnidam routes requests to independent providers such as OpenAI and Google. We do not control their models, pricing, availability, or policies. Your use of a model may also be subject to that provider's terms.

Provider outages or changes may temporarily affect Omnidam features (including Compare). Such events are not a breach of these Terms. How data is handled by providers is described in our Privacy Policy.

9. Subscriptions & billing

Plus and Pro are billed monthly through Stripe when enabled for your workspace. By subscribing, you authorize recurring charges until you cancel. Manage billing from Settings → Manage subscription.

• Cancellation takes effect at the end of the current billing period.
• We do not provide refunds or prorated credits for partial months unless required by law.
• If you downgrade while over Free storage limits, new uploads may be blocked until you free space; existing files are not deleted automatically.
• Failed payments may restrict paid features or downgrade your plan after retry attempts.

10. Intellectual property

Omnidam's name, branding, software, and interface are owned by Omnidam or its licensors. These Terms grant you a limited, non-exclusive, revocable license to use the service for personal use in accordance with these Terms.

If you send feedback or suggestions, you grant us permission to use them without restriction or compensation.

11. Copyright & DMCA

Omnidam respects intellectual property rights. If you believe material on our service infringes your copyright, send a DMCA notice to our designated agent at omnidam@gmail.com including: your signature; identification of the work; identification of the material; your contact information; a good-faith statement; and a statement under penalty of perjury that your notice is accurate.

12. Privacy

Our collection and use of personal data is described in the Privacy Policy, which is incorporated into these Terms. Commercial API usage means your prompts and workspace data are not used to train future models by Omnidam or the providers we use under those agreements.

13. Availability

Omnidam is provided on an "as available" basis. We aim for reliable service but do not guarantee uninterrupted access or any specific uptime. Maintenance, bugs, and third-party outages may temporarily limit features.

14. Termination

You may stop using Omnidam and delete your account at any time. We may suspend or terminate access if you breach these Terms, create risk for us or others, or where required by law. Upon termination, your right to use the service ends; provisions that should survive (including disclaimers and liability limits) remain in effect.

15. Disclaimers & liability

THE SERVICE AND ALL AI OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, OMNIDAM AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON AI OUTPUTS.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO OMNIDAM IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

16. Changes

We may update these Terms from time to time. We will post the revised version with a new "Last updated" date. Material changes may also be communicated by email or in-product notice where appropriate. Continued use after changes take effect constitutes acceptance.
